// How to file a complaint

REALTORS® are held to a higher standard through the NAR Code of Ethics, which promotes honesty, integrity, and professionalism in all real estate transactions. Wondering what behaviors violate the Code? Common issues include misrepresentation, failure to disclose, or lack of cooperation with other agents. If you believe a REALTOR® has breached the Code, you can file a complaint through your local association by submitting a written statement and relevant evidence.     ETHICS COMPLAINTS, ARBITRATION REQUESTS AND RELATED INFORMATION

    For Consumers and REALTORS®: NAR's Code of Ethics and Professional Standards

    REALTORS® are different from non-member licensees in that they voluntarily subscribe to a strict Code of Ethics. If you believe that a REALTOR® has violated one or more Articles of the Code of Ethics, you can file an ethics complaint alleging a violation(s) through the Gainesville-Alachua County Association of REALTORS® where the REALTOR® holds membership, or participates in a REALTOR® association-owned/operated MLS. You may search for a member's local affiliation here.

    In addition, REALTORS® agree as a condition of membership to arbitrate contractual disputes and specific non-contractual disputes as provided for in Article 17 of the NAR Code of Ethics.

    NAR's Board of Directors approved changing the timing for the Code of Ethics training requirement, extending it from every two years to every three years. This extends the current cycle deadline (Cycle 6) from December 31, 2020 to December 31, 2021.

  • How to file a complaint

    Prior to filing a complaint, you are encouraged to contact your agent and/or their broker to ensure they are aware of your issues; they may be able to satisfactorily resolve the issues before it rises to an official complaint.

    In formulating your ethics complaint, ensure that you refer to specific articles of the Code of Ethics, so that our Grievance Committee can determine whether or not evidence exists sufficient to warrant the holding of a Professional Standards hearing. Please include a typewritten explanation of the circumstances that prompted you to file your complaint.

    Further--and this is important--please understand that when a REALTOR® is charged with a violation of the Code of Ethics, the complaining party cannot recover damages, either actual or punitive. Should a REALTOR® be found guilty of violation of one or more articles of the Code of Ethics he may receive a letter of reprimand, a fine up to $15,000, suspension of membership, required attendance at an educational seminar, or termination of membership. The Board of REALTORS® is not empowered to force a REALTOR® to pay damages of any kind.

    When the complaint is fully completed and returned to the Board, it will be placed before a panel of at least three members of the Grievance Committee. Should there be a hearing scheduled before a Professional Standards Hearing Panel, you will be notified well in advance, in order that you may be represented by counsel, if you wish, and in order that you may call whatever witnesses you desire.
